Overview

We're consulting on proposed changes to the fees we charge for regulating operators under the UK Emissions Trading Scheme (ETS), by way of the Greenhouse Gas Emissions Trading Fees and Charges Scheme 2020 (as amended) (the ETS Charging Scheme).

The proposed amendments to the ETS Charging Scheme will be of particular interest to main scheme operators who qualify for free allocation of emissions allowances and participants in the Hospital and Small Emitter (HSE) scheme.

Why your views matter

We're the regulator for UK ETS in Scotland. In support of this, we levy operators of installations and aircraft operators with a range of charges for different activities under:

  • The Greenhouse Gas Emissions Trading Scheme Order 2020 (the UK ETS Order).
  • The Commission Delegated Regulation (EU) 2019/331 (the Free Allocation Regulation).
  • The Commission Implementing Regulation (EU) 2019/1842 (the Activity Level Change Regulation).

This consultation proposes the following amendments to the ETS Charging Scheme:

  1. Introduce new subsistence charges/bands for operators of installations who are claiming free allocation of emissions allowances.
  2. Amend rule 12 to expand the list of activities to which the hourly rate applies.

Please note that, in line with the Scottish Public Finance Manual and HM Treasury Managing Public Money, public sector organisations should fully recover costs for services provided.

We need to be open about what we charge for, and what we do not, and this needs to be agreed by Scottish Ministers. This consultation provides you with the opportunity to give your views on the proposed changes to our charges.
